Seminario internacional online ‘Derecho penal y Derechos Humanos’

Los derechos humanos y su garantía es la prerrogativa básica del sistema penal y de una política criminal de corte individualista, en el que el Estado debe servir necesariamente a la persona. Por tanto, ello no significa sólo que el Estado debe respetar los derechos humanos, sino que también debe hacer respetar tales derechos y libertades de las personas ante las injerencias de todos –tanto de otros individuos como del propio aparato estatal-, mediante el uso del medio más coercitivo que éste ostenta, el derecho penal.

En las sociedades conflictivas actuales, es necesario replantearse el clásico ligamen entre derecho penal y derechos humanos, repensando viejos problemas y adelantándose a los que devendrán en un mundo cada día más global a la vez que más individualista y excluyente de los colectivos más débiles, vulnerables y marginados.
